Abstract

The article is devoted to the specific issues related to balancing power influences the relationship between the social partners with the aspirations of management by the relations between the parties to the social dialogue which arise, particularly in the area of labor relations. Describing the existing legal framework regulating the employment relationship between the parties to the social dialogue, highlight some problematic issues related to the settlement of these relations and provided suggestions for possible solutions to some of them, that is the purpose of the article. The possible solutions to certain aspects of existing problems of legal settlement between the parties to the social dialogue in particular such as quotas recruitment of certain categories of workers, contract form of employment contract, the relationship between the employer and the elected body of primary trade union organization at the termination of the employment contract by the employer, subject to compliance with social standards related to wages. Special attention is paid to the separation of social dialogue at various levels of the meeting.
