Abstract
One of the key challenges of the artificial intelligence era is the issue of authorship recognition and the protection of
intellectual property rights. The aim of this study is to explore approaches to the legal regulation of AI usage in Ukraine and
abroad, analyze the threats arising from the unauthorized use of copyright-protected objects by artificial intelligence, and examine
judicial and legislative practices in this field. The study employs both general scientific methods (analysis, generalization, and
synthesis) and specialized research methods, namely the formal-legal and comparative-legal methods. The article defines the key
aspects of legal regulation regarding works created by artificial intelligence. The main approaches to determining the authorship of
AI-generated works are analyzed. Special attention is given to the legal status of AI and the possibility of recognizing it as a subject
of copyright. A comparative analysis of approaches to AI-generated copyright regulation in the United States, the European Union,
China, and other countries is presented. It has been established that the legislation of most countries adheres to the traditional
approach, according to which copyright can only be attributed to a natural person. It is noted that recognizing copyright for
works created with AI involvement may, on the one hand, lead to the devaluation of human artistic labor, while on the other hand,
it may foster innovation and creativity through new technologies. The results of the study suggest that the further development of
intellectual property legislation should be aimed at adapting to modern technological realities and ensuring a balance between the
rights of creators and the advancement of innovation.
